Who are the FreeFlexers employed by?

FreeFlexers are not employed by anyone. This is because all FreeFlexers are self-employed (zelfstandigen zonder personeel). That means they are 18+ and if they work permanently through Temper, they all have their own VAT number.

Suppose we have a good click with someone and we want to offer them a permanent position, is that allowed?

Yes, you may. We do not charge a fee for this. However, we often see that FreeFlexers have consciously chosen this way of working, and value the freedom and opportunity to work for different clients.

What are the costs when I place shifts through Temper?

For each hour worked, you pay us € 3.50 usage fee, to be paid afterwards. This is for using our software, the automatic invoicing, and for the support we provide. This fee is indicated on the platform as follows: € 18.50 (€ 15 + € 3.50) excl. VAT.

How do we know for sure that FreeFlexers are insured?

FreeFlexers who work via the platform are insured by default in case of accidents or damages caused. Have they worked more than 10 shifts through the platform, they will have a disability insurance in case of long term illness.

How do we know for sure that FreeFlexers build up a pension?

As a client you have no insight into whether FreeFlexers build up a pension. Because FreeFlexers are self-employed it is their own choice and responsibility to build up a pension. However, we do offer all FreeFlexers, through our partners, the opportunity to easily save for retirement through the platform.

Is Temper a party in the agreement between client and FreeFlexer?

No. Temper merely acts as a digital notice board where client and FreeFlexer can find each other. Once there is a 'match' between both parties, an 'assignment agreement' for the duration of the shift is concluded between you as the client and the FreeFlexer. This assignment agreement serves as a contract in which you agree on the required skills, the duration of the shift and the corresponding compensation.

We get credit, but what does that mean exactly?

Our billing partner Finqle provides you with a certain credit level, after determining your credit rating. With that credit, the FreeFlexer is paid within three working days after a checkout is accepted. We have deliberately organised it this way because we know that FreeFlexers like to be paid as soon as possible. In this case you will receive, for example once a month, a collective invoice in which several FreeFlexers are listed plus the user fee.

Are the factoring fees included in Temper's user fee?

No. Factoring fees are borne by the FreeFlexer. They can choose to be paid directly at checkout. For this service, Finqle charges them 2.9%. FreeFlexers can also choose to wait for the client to pay out, which does not incur any additional costs. As a client you're not affected by these factoring costs.

How many hours can FreeFlexers work with us on a yearly basis?

FreeFlexers are allowed to work a maximum of 660 hours per client per year. This is a limit that we have set as a platform to ensure that FreeFlexers work for multiple clients and thus remain truly entrepreneurial.

What happens if you exceed that limit (660 hours)?

The 660 hour limit is built into our platform. This means that a FreeFlexer can no longer respond to shifts with a particular client once they have worked there for 660 hours.


What is the difference between a temp agency and Temper?

There are many differences between a temp agency and Temper. The main difference is that a temp agency employs all the workers while Temper is just a digital noticeboard where independent professionals can connect with clients. This offers the worker (FreeFlexer) complete freedom and flexibility while also earning more. This is why FreeFlexers are often seen as quality and motivated workers.

Is Temper responsible for scheduling breaks for FreeFlexers?

As previously stated, Temper is not a party to the contract. Temper therefore bears no responsibility for the resting periods of the FreeFlexer. Since FreeFlexers are independent professionals (zzp'ers), they decide themselves about their rest times. In consultation with you as a client of course.

What requirements can I set for a FreeFlexer?

For each shift you place on Temper, you have the option to indicate which skills a FreeFlexer should have. Additionally, transparent ratings and records on attendance and timeliness give you insight into the qualities of a FreeFlexer. Ultimately, a FreeFlexer remains a self-employed person and should therefore also have the freedom to determine how they carry out their work.

What is free substitutability and why is it important?

One of the main pillars of the Temper Model is that of free replaceability. This means that a FreeFlexer is always allowed, both through the platform and outside, to be replaced by someone with similar qualifications. It is important that it is really about 'free' substitution, so this also means that you as a client may not make any extra demands or reject a replacement. It is the responsibility of the FreeFlexer to inform a client when they have been replaced outside of the platform. Only if the FreeFlexer fails to do so may you, as a client, send a (then unannounced) substitute home.

By allowing free replacement, we ensure that FreeFlexers working through Temper are self-employed (zzp'ers) and are not seen as employees. This is primarily to protect you as clients. After all, if FreeFlexers were to be regarded as employees, this would have consequences for the payment of employee insurance premiums, for example.

Do I know for sure who will be working there?

Yes, when a FreeFlexer is replaced outside the platform, it is their responsibility to let you, the client, know who is coming as a replacement. If the replacement has gone through the platform, the replacement will be on the shift and you will also receive an email to let you know that a FreeFlexer has found a replacement.

How can I be sure that the FreeFlexer standing in front of me is who they say they are?

As a client, you may always ask for proof of identity from the FreeFlexer. Do mention in the additional briefing that it is mandatory to bring it. You can compare the document number and the expiration date with what is written on the FreeFlexer's profile. The last digits of the document number are shown here.

What is the value of a rating a FreeFlexer?

When you're assessing the FreeFlexer that worked for you, you will get the opportunity to provide a rating, and the chance to be specific by indicating how the FreeFlexer did in different areas. By doing so you help the FreeFlexer to improve or compliment themselves on these points. Transparent and reliable reviews are the basis of a well functioning platform.

Why do you have a minimum fee and how is it structured?

We find it important that Temper is used for interesting jobs and that FreeFlexers deliver a certain level of quality. We have therefore chosen to set minimum rates in order to keep the platform free from jobs for which the rates are too low. Different minimum rates apply depending on the job category. The lowest minimum rate that applies on Temper is €14,- per hour.

Do I have to abide by the collective agreement wages for FreeFlexers?

FreeFlexers are independent professionals, they are not employed. Therefore they do not fall under a collective agreement.

Is this set-up recognised by the government?

On July 26, 2016, the Belastingdienst approved a model agreement submitted by Temper B.V., which stated that working in accordance to the submitted agreement our model does not lead to a (fictitious) employment relationship. This agreement can be found in the register agreements DBA with indemnification under number: 9061636558.
